An acquaintance of Anna Nicole Smith's, Laurie Payne, who spent a great deal of time with Anna at the time of her preganancy, revealed in sealed court documents what she'd witnessed during that time. According to Payne, Anna admitted to her in phone calls and instand messages that Larry Birkhead is the father of her daughter. Additionally, Payne stated that Smith was taking both methadone and Xanax during the time of her pregnancy. However, despite the very juicy gossip this information contains, the best part of Payne's testimony was in reference to Smith's son, Daniel, and Howard K. Stern. From TMZ:
As for Howard K. Stern, Smith's lawyer who is listed as the baby's father on her birth certificate, Payne says Anna Nicole Smith herself said he wasn't the father. Payne says in her declaration: "I asked her why she did not just go into a relationship with Stern, to which (Anna Nicole) responded, 'EWWW...GROSS!!! No way!! I would never!'" According to the declaration, during Christmas, 2005, Stern began to tease Anna Nicole's son Daniel "about being a 19-year-old virgin." Payne says, "....Daniel looked at Stern and stated, 'I don't know why you're worried about me, you've been around my mother for 12 years and haven't had any p*ssy either."Damn. That's one less smart-ass in the world. Makes his passing even more of a shame, as far as I'm concerned.

I know alot of people hate Howard K Stern, but I feel bad for him. First of all he loved Anna Nicole Smith. He stood by her even while she was with others. I am sure he loves her baby also, not the money. He hasn't even had a chance to grieve for her yet. As for her mother, she should be ashamed of herself, Anna needs buried by her beloved son. How can Virgie have a heart and bury Anna where she never wanted to be?

I feel that Howard K. Stern has been deeply hurt by the news media to the point that the Bahamian Court has been influenced to make decesions different from what they would normally do. Anyone should be able to see what Anna Nicole wanted. She stated very bluntly how she felt for her Mother and it was her desire for her Mother not to touch her bsby. And she had gotten as far away from Berkhead as she could. I believe that Mr.Berkhead was using Anna to try to get in on any money that was up in the air to be gotten Howard wss the only good thing going for Anna and Anna realized that. What type of person would it take to send the terrible emails that Mr. Berkhead sent to her! That Florida judge had more sense than people gave him credit for! Do you remember his asking Mr.Berkhead if he did not think that the email that he had sent to Anna could have pushed her over the edge? That judge also said that Howard was the only real support system that Anna had and that is the truth of the situation. I had a brother that was addicted and I did things that I now see that I shouldn't have done. But if you talk to anyone who has a love one on drugs, you will see the confusion created. The addict is usually able to convience you that they have it under control and that everything is going to be OK. I pray that Howard is the father. As far as I am concerned he is. Things are the way that Anna wanted them to be. Why do you think that Mr.Berkhead did not come to the Bahamas and be there trying to get his name on the birth certificate? He knew that Anna would run him off because she saw him for what he was! I pray that the Bahamanian Courts and the Justice will realize all the news "hep" caused by the news media continually discussing their opinions and not facts about this situation They has been nothing but a "Reality News Shows" since this all happened with no consideration for Anna or the Baby. The News media have been the judge and the jury accusing Howard of Murder, calling hin a freeloader and very hurtful things with no evidence what so ever. It has broke my heart to see what the USA News Media is capable of. Howard had worked for Anna with complete loyality and consideration for her! He has looked after her and been her confidant! For Berkhead to step in now and take control of things to include take the baby even if his DNA matched, would be a castrophe! Anna had the name of the man she considered and wanted to be on the birth certificate and the court should honor that decesion! I am ashamed of our USA court systems! I have looked at the way your courts have considered the paternity of the child being the legal father and respected your way of seeing that. Please do not allow the USA news media to influence your decesionsl Howard if you have any recourse you can take regarding the way your reputation has been damaged, I pray that you can do something about it. There is so much that I would like to say but I won"t. Who is paying for the legal fees and the living expenses for Mr.Berkhead and Virgie? Someone is! Howarad is the babys only hope. I pray that the baby will be with Howad and that his Mother and Father will be the Grandparents to the baby. Howard and his family will be the best thing that could happen to the baby. Virgies mean temperment and judgemental disposition is what caused Anna Nicole to be unhappy and caused her to be unhappy. Between a Daddy that never saw her, and a Mother that did not even want to be called at 4:00AM because she had to get up at 7:00AM and was that insensitive to Anna when she called her, how could she possibly be a Grandmother to this baby? Where has she been all this time? My prayers are with Howard K. Stern! And I know that he is the Daddy because Anna had Howards name on the birth certificte! It is heart breaking to see all those Bahamian people running around and saying to Berkhead "Your the Daddy! Your the Daddy!" Anyone should be able to see that he is a showboat and only interested in what he can get out of Anna..Anna saw that, and that is why she went away to get away from him and her family. bluntly! Anna Smith was so drug up so badly and she couldn't speak that very good. when you're so drug up it is like so drunk up! I am sure Howard Stern took advantage of that and He already mind practice program on Anna's mind. Anna surely tired of Howard follow her around for years. Howard knew way around her and knows her weakness.
Don't forget that Daniel Smith didn't even like Howard Stern at all. Daniel Smith went to see PI on about Howard pimping his mother. Daniel was going to do that after he gets out of Bahamas.
Daniel was drop dead at visit to his half baby sister Dannielynn. Anna never find out what cause Daniel's Death. that why Anna was so drug up and she was gone too.
