Paris Hilton is in court once again, but this time she's the one doing the suing. The
LA Times reports that the appeals court has upheld a lawsuit in which Paris is suing
Hallmark Cards Inc. for wrongfully using her name and image on a birthday card.
Hallmark had requested that he suit be dismissed, however the U.S. 9th Circuit Court of Appeals rejected Hallmark's defense that the card was "in the public interest."
Judge Diarmuid O'Scannlain said of the suit, "Hallmark cannot employ the public interest defense because its birthday card does not publish or report information."
The card showed Paris' head on a cartoon waitress body with a line that read "Paris's First Day as a Waitress." This was presumably based on an episode of the show
The Simple Life, where Paris did indeed work as a waitress.
Paris is currently seeking at least $100,000 in damages and is accusing Hallmark of "commercial appropriation of identity and invasion of privacy." Paris has been on the
winning streak when it comes to lawsuits recently, so maybe she'll prove victorious once more.
